Supreme Court: It’s O.K. to Use Race When Arresting Alleged Undocumented Immigrants, But Not to Achieve Diversity in Higher Education

(Todd A. Smith)

The United States Supreme Court stated that race can be considered when police and ICE agents are rounding up suspected undocumented immigrants.

However, the same court earlier stated that race could not be used in considering the admission of prospective college students, even if it would lead to more diverse classrooms.

In a nutshell, the Supreme Court decided that race can be used when it discriminates against people of color.

But race cannot be used if it levels the playing field for people of color who have long been discriminated against in a country that touts being colorblind, but openly wants to maintain White power.

Lindsay Whitehurst of Associated Press reported, “The Supreme Court on Monday cleared the way for federal agents to conduct sweeping immigration operations for now in Los Angeles, the latest victory for President Donald Trump’s administration at the high court.

“The conservative majority lifted a restraining order from a judge who found the roving patrols were conducting indiscriminate stops in and around L.A.

“The order had barred immigration agents from stopping people solely based on their race, language, job or location.”

I want to ask MAGA supporters a question.

Many have told me that race should not matter in America, and we should stop talking about it.

If we did, racism would go away, many of them say.

Therefore, how do they feel about the conservative Supreme Court allowing law enforcement officials to use race, ethnicity, working at a low-paying job and speaking a foreign language when rounding up suspected undocumented immigrants?

But at the same time, the Supreme Court also said that race could not be used to create diverse classrooms and workplaces because it discriminates against White people.

Why is it O.K. to discriminate against Hispanic, Asian or African people, but then discrimination is only a problem when White people feel that they have been oppressed?

Shouldn’t it be wrong to discriminate against anyone, regardless of their physical appearance, race or ethnicity?

That conundrum that the Supreme Court created for itself encapsulates all that is wrong with America.

When people of color have been done wrong, who cares?

But when White people feel like people of color are taking opportunities from them, all hell breaks loose.

When White people have been done wrong, laws and policies must change to make it more difficult for minorities to climb the ladder of success.

When White people feel that they are losing power, qualified Black women must lose their jobs, while unqualified White men like Robert F. Kennedy, Jr. and Pete Hegseth get presidential cabinet jobs that they are totally inept at doing.

When White people feel their control slipping away due to the browning of America, they want to deport immigrants, even those who came to America legally, like the Haitian migrants in Ohio.

But when Black people complain about racism, we are told to stop playing the race card.

When Black people can prove systemic racism in areas like banking and housing, many White people act as if they don’t care that generational wealth may be based on melanin instead of merit.

Many White European migrants are in America illegally because they have overstayed their visas.

But I have yet to see ICE do sweeping raids of White communities because the people have an Irish, British or French accent.

What I have seen is mostly Hispanic people, and some from predominantly Black nations, get rounded up and shipped out of America, even those without criminal records.

That leads any rational person to discern that the raids have never been about securing the border and getting rid of hardened criminals.

It has never been about fixing broken immigration policies.

The obsession with immigration is just a desperate effort to maintain the racial status quo in a country that many predict will be majority minority in the coming decades.

With more people of color in America, that means less power for White people.

Therefore, White America must do something to maintain White power before the power is more equally shared amongst all Americans, regardless of skin color.

That is why President Trump is advocating for such racist policies.

In her dissent, Justice Sonia Sotomayor wrote, “Countless people in the Los Angeles area have been grabbed, thrown to the ground, and handcuffed simply because of their looks, their accents, and the fact they make a living by doing manual labor.

“Today, the Court needlessly subjects countless more to these exact indignities.”

Unfortunately, people of color have often faced indignities at the hands of the majority.

Race relations in America are great if people of color stay in their so-called place.

Racial animosity reaches a boiling point when people of color make too much progress, which threatens some people’s false sense of superiority.

That is why Trump is cracking down on Hispanic migrants.

That is why Trump is cracking down on diversity.

That is why Trump is constantly berating Black women while attempting to fire Black women whom he has no authority.

That is why so many poor and middle-class White people voted against former Vice President Kamala Harris when her policies would have benefited them more than Trump’s policies, which favor the ultrawealthy.

Whenever there has been minority progress in America, it has been met with angry White male backlash.

Black people experienced it after Reconstruction, the Civil Rights Movement and the historic election of former President Barack Obama.

Now, migrants, specifically those from Latin countries, are feeling the pain, cruelty and heartlessness of White supremacy, even though so many White supremacists claim to be colorblind.
